Telecommunications

Legal Section

Gedara’s law firm has the experience to give legal advices and work on cases within this field due to the participations in the following:

  • The preparation of the Temporary Telecommunications Law No. (8) of the year 2002;
  • The preparation of the General Policy of the Government in the ICT Sectors and Postal Sector;
  • The preparation of the following Regulations: Safeguard competition, interconnection instruction, rule-making, dispute resolution, enforcement, quality of service (QOS), universal service obligation (USO), and licensing program (for fixed line and mobile);
  • The establishment of the general goals, action plans, and strategic plans of the TRC;
  • Developing the laws and regulations of the TRC.

In addition to the following experiences:

  • Supervised the preparation of the license agreements that have been made and given by the TRC for third parties, in addition to the revision of such agreements that had been made by third parties and giving legal consultation on their applicability;
  • Drafting English version Telecommunications Contracts, including Interconnection Agreements, International Services Agreements, Installation of Networks Agreements, Fiber Link Business Services Agreements, Internet Services Agreements, Info-Structure for Cable and Internet Services Agreements, Individual License Agreements, Class License Agreements, Maintenance and Supply of Services Agreements, and Carrier Services Agreements;
  • Provided legal studies and propositions as for amending, renewing, and canceling license agreements;
  • Supervised the preparation of the studies and researches regarding the TRC’s activities;
  • Represented the TRC in all legal proceedings;
  • Supervised the legal consultations that have been given to all TRC’s Departments, including internal laws and regulations and international conventions;
  • Contributed in the dispute settlements that have been made among the licensees, and between the licensees and their participants;
  • Trained the TRC legal employees in various fields and departments;
  • Membership of the Technical Committee for the Privatization of Jordan Telecom.

Technical Section

Our associate, Mr. Mohammad A. Mehyar, is a Technical Engineer assisting in setting up new telecommunication services and operation from the technical and business model set up to the regulatory part. He was the Director for the Regulatory Department and Head of Telecommunication Regulatory Section of the Telecommunications Regulatory Commission (TRC) in Jordan, the Information Technology Manager of Jordan Modern Telecommunication Networks Services Company, and the Jordan Public Payphone Services (Rumeli Holding). Mr. Mehyar is specialized in Telecommunication Operations (TDM, VOIP, and Wireless), Billing Platforms, Technical Enterprise Solutions, Prepaid Platforms, Payphone Operations, Telecommunications Regulation, IT Operation, and Management.

Property

Gedara team provides various legal services in the field of land law including the Real Estate Property Law and the Owners and Lessees Law that regulates the relationship between owners and tenants in Jordan. Our legal services include drafting lease contracts, whether commercial or residential leases, for both owners and tenants and advising our regional and international clients in purchasing, letting, and disposal of premises. In addition, the legal services include setting up and licensing real estate businesses, drafting sale of real estate contracts and settling real estate disputes, and has an excellent experience in acquisition cases concerning real estates.

Intellectual Property

Gedara team is capable of conducting searches and design evaluations, preparing and filing applications (registration of patents, trademarks, and industrial designs), portfolio management, enforcing Intellectual Property Rights (including trade secrets and unfair competition cases) both in and outside courts, transferring title, preparing licenses and assignments, drafting franchise, distributorship and joint-venture agreements.

Employment

Gedara team provides various legal services for its regional and international clients on all aspects of Jordanian Labor Law as well as Social security Law including drafting labor contracts, internal regulatory frameworks and employment compensation. Our law firm’s attorneys have extensive experience in Jordanian labor law and in the field of labor disputes and investment legislations since part of the team was former board members at the Insurance Board and Social Security Investment Fund Board at the Social Security Corporation.

The firm has a long experience in the Mail Sector including:

  • Participated in the preparation of the Temporary Mail Services Law No. (5) of the year 2001;
  • Participated in the preparation of the Licenses of Private Mail Operators Regulation No. (110) of the year 2004;
  • Full knowledge of all cases related to the organization of mail sector, and providing mail services from the general mail operator (Jordan Post Company) and the private mail operators;

Media Sector

Gedara team has a high experience in Media Law especially in light of the extensive growth of this field in Jordan and the Middle Eastern region, as one of the senior partners contributed in the preparation of the Audiovisual Media Law, and had a role in the Freedom of Media Commission and the Development of Studying Plans Commission in the Higher Media Council.

Our experience in arbitration is represented by appointing the senior partners of our law firm as arbitrators in many various arbitration cases, in addition to our representation as lawyers before multiple arbitral tribunals. It should also be noted that one of our senior partners has experience in the Fidic Contract, where he reviewed, revised and amended the current version of the Fidic contract at the Ministry of Public Works & Housing through his participation as being a member of a legal and technical committee formed by the Council of Ministers for this purpose.
